Welcome to Red Shiner! We own and operate this website (Redshiner), any related mobile sites and mobile application(s), and other selected domains including the materials on them, from text to photos to videos to graphics and software.
Definitions
“We”, “us” and “our” shall mean Redshiner and its affiliates. “Outfitter” refers to the person, agency or company responsible for delivering and managing fishing charter services offered through Redshiner.ca. Service refers to the reservation of fishing trips via Redshiner through which outfitters can make their fishing trip services available online for reservation, and through which customers can make such fishing trip reservations with outfitters.
The following outlines terms of use “Agreement” that binds a contract between you and us. By using Redshiner site and any related domains, you agree to all terms and conditions of this Agreement. If you do not agree to the terms and conditions of this Agreement, please leave this page immediately and refrain from using this site.
Use of Site
By using this site you confirm that you are at least thirtheen (15) years old; of legal age to form a binding contract; not a person banned from using the site under the Canadian law; your place of residence or any other applicable jurisdiction; and your use of the Redshiner does not violate any agreements with any third party, including and not limited to, any agreement with a mobile service or internet service provider. You agree that you shall restrict use by minors, and you will accept full responsibility for any unauthorized use of the materials or the site by minors. You agree not to use the site if you have been previously removed by Redshiner, or if you have been previously banned from this site.
In regards to products and services offered by Redshiner through the site, you will be informed of all terms of the offer, including but not limited to pricing, methods of payment and sales tax (if applicable) where you make the purchase.
You understand that the site is ever evolving, therefore you acknowledge and agree that Redshiner may update the site with or without notifying you.
You must provide all equipment necessary to access the site. You are solely responsible for any fees, including Internet connection or mobile fees that you incur when accessing the site and its materials.
Outline of Services
Redshiner serves only in the capacity and/on behalf of the outfitter providing the services. By completing a booking on Redshiner you enter into a contract directly with the outfitter and you will be subject to their own terms and conditions. By confirming your booking you accept outfitter’s terms and conditions as well as our terms and conditions.
We act solely as an intermediary between you and the outfitter by transmitting the details of the reservation to the relevant outfitter and forwarding you email confirmation for/and on behalf of the outfitter.
You authorize Redshiner to complete reservations for the total reservation price, which includes the rate displayed on the site.
We reserve the right to cancel your booking if full payment is not received in a timely fashion. You acknowledge that some outfitters offer certain services and/or activities that may require you to sign their liability waiver prior to participating in the service and/or activity they offer.
Some of the services may only require a deposit at the time of booking for you to secure your fishing trip. Any outstanding balance is due to be paid to the outfitter through our site prior to using the services If you do not pay your balance prior to consuming outfitter’s services, the outfitter may cancel the booking and charge any cancellation fees as set out in the outfitter’s terms and conditions.
Any cancellation or change request must be sent to Redshiner in writing; and will not take effect until received and acknowledged by us.
By making a reservation with an outfitter, you accept and agree to the relevant cancellation and no-show policy of that outfitter, and to any additional (delivery) terms and conditions of the outfitter that may apply to your reservation. The general cancellation and no-show policy of each outfitter is made available on our website on the outfitter’s profile page, and will be available during the reservation procedure and in the confirmation email. Please note that certain rates might not eligible for cancellation or change. Please check the outfitter’s details thoroughly for such conditions before making the reservation.
Shall you need to adjust or cancel your reservation, you must consult the confirmation email and follow the instructions enclosed within. You may cancel or change your prepaid reservation in accordance with the individual outfitter`s selected cancellation policy prior to the start date of the reservation. Please note that you may be charged for your cancellation in accordance with the outfitter’s cancellation and no-show policy. We recommend that you read the cancellation and no-show policy of the outfitter carefully prior to making a reservation.
Redshiner does not carry responsibility nor offers any discount/refund for missed or unused services which by the customer due to no fault of Redshiner’s or Redshiner’s representatives.
Redshiner does not carry liability for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or of any other authorities, accidents to or failure of machinery or equipment or industrial action.
Please note that outfitters carry the ultimate responsibility for the safety of the crew and the people onboard. In the event that the trip is no longer safe due to any reason, the outfitter has the right to cancel the whole or part of the trip (before or after departure).
If the booking is cancelled to due unsafe weather conditions prior to departure, customer has the choice to:
- Accept a substitute booking in equivalent value, where reasonably available.
- Accept full refund minus transaction fees.
Redshiner is not responsible for any incidental expenses or consequential losses that the customer may have incurred as a result of the cancelled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. Redshiner reserves the right to issue a full refund in lieu of the choices above, in its sole discretion.
While Redshiner encourages reviews and feedback of the outfitters and your recent trips, Redshiner don’t address any complaints with the outfitter, as your contract is directly with them. We will do our best to assist you with any queries or concerns you may have in regards to your arrangements. If you wish to complain upon your return home, please leave any comments on our site and contact the outfitter directly. Redshiner will provide outfitter’s contact details on the confirmation documents it sends you.
Redshiner does not accept any responsibility for costs you incur as a result of not being adequately insured. Some outfitters may require that you take out suitable insurance cover and inform the outfitter of whom you are insured with.
Once you receive your confirmation e-mail, please check it carefully to make sure that all details are correct and also ensure that the names provided are the same as in the ID documents you will might need to present to the outfitter. If you believe one or more details are not correct, you must contact Redshiner immediately. Please ensure you check the information provided so that you are fully aware of timings, durations, departures and other details.
With every effort made to ensure the information presented is complete and accurate, Redshiner accepts no liability for any injury to persons, or any loss or damage to property caused by errors or omissions in the data presented, whether it results from negligence, accident or any other cause.
To outfitters only: You may sign up to receive text message alerts about your order placed on Redshiner.ca or through the upcoming Redshiner.ca mobile application. Please note that standard data and message rates may be applicable to text message alerts. For more info please contact your mobile phone carrier.
Material and User Content
Redshiner and the content of the site is protected by copyright, trademark, trade dress, domain name, patent, trade secret, international treaties and/or other proprietary rights and laws in Canada. With exception of trademarks, service marks, logos and trade names of other companies that may be displayed on the site, all trademarks, service marks, logos, trade dress and trade names are proprietary of Redshiner without limitation.
No content/ materials may be copied, republished, uploaded, posted, transmitted, distributed in any way, and/or modified without Redshiner’s written permission. Nothing presented on the site should be interpreted as granting to you the right to use any of the content and/or third party proprietary content on the site without the written permission of Redshiner or the appropriate third party owner, as applicable.
Redshiner may provide you with interactive opportunities and features such as user ratings, saved favorites; liked outfitters; reviews. You represent and accept that you are the owner and have the right to provide all information, comments, reviews, ratings other or content that you submit, post/transmit to the site.
You agree to grant Redshiner an irrevocable, transferable, royalty-free, perpetual, non-exclusive worldwide sub-licensable license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works from, distribute and use User Content on the site in all forms of media now known or hereafter invented without notification and approval by you.
By agreeing to these terms you grant Redshiner the right to use your username and user profile information, including without limitation, history of ratings and how long you have been a member.
Redshiner reserves the right to change, delete and remove whether in part or in full any user content that we may find inappropriate (to our sole discretion); and/or see violating our standards, and interfering with other peoples' enjoyment of the site.
